I think you have grounds for breaking the lease! You could contact a lawyer on that. What state do you live in? It sounds liberal. Lynne - You are right on!! It is a very liberal State. Coincidentally I have just spent the last couple of hours researching if I had legal recourse to break the lease. Also, landlords can be held liable for renting to drug dealers and for putting tenants safety at risk. Does anyone know a good conservative State to move to on the east coast?

PA...WEST of Philly is all pretty good Voxx - Coincidentally I am originally from north central PA (small town girl). My husband went to a teacher's conference in Philly a few months ago and came home raving about how much he liked it compared to down here. As much as I would like to move out of this State, realistically given my husband's age (60 yrs), I doubt he would get another teaching job.

There are numerous small colleges and publicschools all around the state...God will provide.

UPDATE: I just talked to the Assistant Manager at the management office. They said that they would be willing to move us to another apt in the complex. There is a $300.00 transfer fee to change apts and I told them they would have to waive the fee for me to consider it. At least I wouldn't have to wait until October when the lease is up to move. I realize it will be in the same complex, but the complex is huge and I will at least be away from the goings on next door. Just hope I won't be jumping from the frying pan into the fire! Have to run it by my husband when he gets home.

I am praying that everything works out with the changing of the apartment... If you all are still struggling with things like this by October, I would definitely recommend moving to a less liberal state if your husband is in agreement with doing so. PA is great because then Voxx would be close enough to beat up any bad guys for you!!! Virginia is also nice, but perhaps I am prejudiced because that it where I live... I think the biggest thing is try to stay away from the big cities and shady parts of towns. Almost every town or city has them. My sister Teresa lives in Manassas, VA where there are lots of ghetto gangs, but she lives in a safe part of town and never has any trouble.

I am praying that everything works out with the changing of the apartment... Things can change so fast around here. What were once nice and quite neighborhoods change, seemingly, almost overnight to the pits. The State wants to mandate that every landlord has to take vouchers. Then things will really go downhill fast everywhere. Unfortunately my husband works in the City and we live in the suburbs which isn't that far out of the City so he has a relatively short commute to work by bus. Right now we need to stay here due to his job. If we had our way we would be living in a small town in Pa.

UPDATE: Have a funny feeling that someone in the management office is in communication with the person next door. When I talked to the Assistant Manager this morning she said she was going to come over here to smell the hallway and try to get to the bottom of the skunk smell. Well the guy next door's apt has been the quietest it has been since he moved in a month ago. No traffic at all and no smell in the hallway. Coincidental - I think not! Also, the Assistant Manager was way too quick in offering us another apt, especially saying the $300 transfer fee may be waived for changing apts. Something weird is going on. Anybody have any thoughts??
Also, I think if we transferred apts a new lease date would start from the date we moved into the new apt.

The fact that this is being offered is proof they know they breached the lease agreement and any better call saul type lawyer would win a suit against them. Tell them youll consider staying if the new apt is ok...consider it...then move.

UPDATE: Just ran the offer the management offered by my husband. He said we can't keep moving because we don't like our neighbors. He likes our apt as it has a patio and the patio faces a wooded area with a stream. He likes to sit on the patio in the summer and enjoy the country feel he gets from the woods and bustling stream. I guess the location trumps what is going on next door. I am a nervous wreck over all this. Prayers please!!!!!
